1. About these terms

AR Drawing is operated by Halima Belmatrag, based in Morocco ("we", "us", or "our"). Contact us at belmatraghalima@gmail.com for questions about the app, subscriptions, content, or these terms.

These terms cover your use of AR Drawing's drawing tools, sketch catalog, lessons, text art, photo processing, AI generation, advertising, and related services. Please read them before using the app. Where an affirmative acceptance is required by law, we will obtain that acceptance; these terms do not replace any separate consent required for processing personal information.

The software license for the iOS app is governed by the applicable end-user license agreement supplied through the App Store, including Apple's Standard EULA (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) where no valid custom EULA is supplied. These terms supplement that license with terms for our features and services. They do not override the applicable Apple license, App Store purchase rules, or mandatory consumer rights.

2. Age and eligibility

AR Drawing is intended for people aged 13 or older. You must not use the app if you are under 13. If you are under the age at which you can legally enter into these terms in your country, use the app only with the permission and supervision of a parent or legal guardian. Obtain the necessary permission before making purchases or submitting another person's information.

You are responsible for complying with applicable laws and the rules associated with your Apple Account and device.

3. App use and intellectual property

Subject to these terms and the applicable Apple license, you may use the app on compatible devices you own or control, as permitted by the App Store's usage rules.

The app's software, branding, interface, and other protected materials belong to us or their respective licensors. Sketches, fonts, model components, and third-party artwork may have separate owners or licenses. Buying a subscription grants access to the disclosed features; it does not transfer ownership of the app, its catalog, fonts, or other third-party materials.

Do not redistribute or resell the app or its catalog as a collection, remove ownership notices, or copy, modify, reverse engineer, or extract the app's software except where applicable law or an applicable open-source license permits it. This restriction concerns the app and protected materials, not a claim to ownership of your original drawings.

Your use, publication, or sale of drawings based on protected reference images must respect the relevant copyright, trademark, publicity, and other rights. Access to a reference image does not automatically grant unrestricted commercial reproduction rights. Any permissions supplied by the relevant content license continue to apply.

4. Your content and acceptable use

You retain the rights you already hold in your own photos, prompts, text, and original artwork. You must own the content you use or have the permissions or other lawful basis needed for that use, including permissions concerning identifiable people where required.

When you request an operation involving your content, you authorize the processing reasonably necessary to carry it out, including sending an AI prompt through our service providers when you request cloud generation. This is a limited permission to operate the requested feature, not an unrestricted license to sell your personal content. Data processing and retention are described in our Privacy Policy, and any separately required privacy consent remains necessary.

Do not use the app to create or distribute illegal material, exploit or sexualize children, harass or threaten people, invade privacy, impersonate someone deceptively, infringe intellectual property, or facilitate fraud. Do not interfere with the app or its services, bypass subscription checks, abuse generation endpoints, manipulate advertising, or attempt to access other people's data.

You are responsible for checking that content you export, share, or publish is lawful and appropriate for its audience. Report suspected rights violations or harmful content to belmatraghalima@gmail.com, with enough information for us to investigate.

5. AI generation and photo processing

The current text-to-sketch feature sends your prompt and generation settings through Google Cloud Functions to Replicate to produce an image. The current photo-to-sketch feature processes selected photos locally on your device. Further details about these data flows and providers appear in our Privacy Policy.

AI output can be inaccurate, unexpected, unsuitable, or similar to output generated for another person. We do not guarantee that an output will be unique, copyright-protected, free of third-party rights, or suitable for commercial use. Review outputs before relying on, sharing, or selling them. Any relevant model or provider license restrictions continue to apply; a subscription does not remove those restrictions.

Do not enter confidential or sensitive information into AI prompts or submit personal information about others without the necessary permission. The app's creative features do not provide professional advice or verify the authenticity of an image.

AI generation requires an internet connection and an available provider. Requests can fail or take time, and a particular model may be replaced or become unavailable. We will handle changes affecting purchased benefits consistently with the purchase terms and applicable consumer law. Any applicable material usage limits must be disclosed before purchase or use; these terms do not establish undisclosed limits on advertised paid benefits.

6. Free features and advertising

AR Drawing includes free features supported by advertising and optional paid features. Ads may appear at disclosed placements or transitions, and delivery can vary by region, privacy choices, device, and ad availability. The app uses Google AdMob, including banner, native, rewarded, and rewarded interstitial formats.

Advertisers are responsible for their offers and destination services. An ad is not an endorsement by us. Any purchase or other interaction you choose to make with an advertiser is separate from your AR Drawing subscription. Do not click ads to artificially increase advertising revenue.

Any benefit specifically offered in exchange for an ad should be described before the ad is shown. These terms do not promise coins, money, or an additional reward simply because an ad uses a particular SDK format, and they do not remove any reward or choice requirements imposed by the advertising provider.

7. Subscriptions, the 3-day trial, and promotional offers

Paid access is offered through Apple in-app purchases. The current app offers weekly and yearly subscription plans, and may display a discounted yearly offer. The price, currency, billing period, benefits, and any introductory or promotional conditions shown in the App Store purchase confirmation apply to the purchase. An equivalent weekly price shown for a yearly plan is a comparison; the yearly amount is billed for the annual period.

The weekly plan may include a 3-day free trial for eligible users. Apple determines introductory-offer eligibility. If you are not eligible, the normal purchase conditions shown by Apple apply. After an eligible trial ends, the subscription renews at the weekly price shown before purchase unless you cancel in time. The yearly and discounted yearly plans do not include that weekly trial unless the purchase confirmation expressly states otherwise.

Subscriptions renew automatically unless canceled. Apple charges your Apple Account according to the purchase confirmation and its applicable billing rules. To avoid renewal after a trial, cancel at least 24 hours before the trial ends, as directed by Apple. You can manage or cancel a subscription through iOS Settings, your name, then Subscriptions. The expiry date and any effect of cancellation are shown by Apple. See Apple's cancellation instructions (https://support.apple.com/en-us/118428).

Deleting the app, stopping use, or closing a paywall does not cancel a subscription. Use Restore Purchases in the app with the relevant Apple Account if you need to recover an eligible existing purchase. Restoration depends on the purchase's current status and applicable Apple rules.

The gift and roulette offer screens present promotional subscription offers. An offer is not cash or a transferable entitlement, and displaying or opening it does not itself create a paid subscription. A purchase requires confirmation through Apple. Check the total price, subscription duration, and renewal terms shown at checkout. Do not assume that a discount applies to every future renewal unless expressly stated in the purchase terms. Price changes and renewed charges are subject to Apple's notice and consent rules and applicable law.

8. Refunds and consumer rights

For purchases billed by Apple, request a refund through Apple's purchase support service (https://reportaproblem.apple.com/). Eligibility is determined under Apple's procedures and applicable consumer law. Contact us if you also need help diagnosing an app or purchase-access problem.

Cancellation generally stops future renewal; it is not automatically a refund of an earlier charge. Nothing in these terms removes statutory refund, withdrawal, warranty, or other consumer rights. Where applicable law requires a remedy for a paid service we fail to provide, those rights remain available. See Apple's refund guidance (https://support.apple.com/en-us/118223).

9. Privacy, permissions, and local files

Our Privacy Policy (https://sites.google.com/view/ar-drawing-app-pp) explains camera and Photos access, local content, AI processing, analytics, advertising, subscriptions, retention, and your privacy choices. These terms are not blanket consent for personal-data processing.

You can manage system permissions through iOS Settings. Some features cannot operate without the permission needed for that feature. Local reminders are optional and can be changed in the app or system notification settings.

Keep copies of drawings or recordings that are important to you. Local content may be affected by app deletion, device loss, storage problems, or your backup settings. Removing an item from the library may not immediately erase every underlying file or cache; exported Photos and shared copies are managed separately. We do not guarantee recovery of local content, subject to responsibilities that cannot be excluded by law.

10. Safe use, connectivity, and external services

Use camera-based tracing and AR tools in a safe place. Position your device securely and remain aware of your surroundings. The app's overlay or alignment is a drawing aid and should not be relied on for safety-critical measurements or navigation.

Internet-dependent features can be affected by connection quality, outages, or provider availability. Your carrier's data and roaming charges remain your responsibility under your carrier agreement. A functioning device and a supported iOS version are needed for the relevant features.

External services used by or linked from the app include Apple, Google AdMob/UMP, Google Cloud Functions, Replicate, RevenueCat, Mixpanel, and resource-hosting providers. Third-party services, websites, and licensed components may have their own applicable conditions. Their role in processing personal information is explained in our Privacy Policy. Our contracts with service providers do not remove our responsibilities to you under applicable law.

11. Updates, changes, and suspension

We may update the app and change features to improve it, address security issues, meet legal requirements, or respond to changes in third-party services. Older app or iOS versions may stop supporting particular features. Updates needed to keep a paid digital service conforming to applicable requirements will be handled as required by law.

We may restrict access where reasonably necessary to address serious abuse, unlawful activity, security risks, or a material breach of these terms. Where appropriate and legally required, we will explain the reason, provide notice, and allow you to contact us to resolve an issue. Urgent action may be needed without advance notice to prevent harm or comply with law.

We will not rely on these terms to arbitrarily remove paid benefits without regard to existing purchase commitments or mandatory remedies. If a paid service is materially changed or discontinued, we will provide required notices and address access, cancellation, or refund obligations under applicable rules. Suspending app access does not by itself cancel Apple's billing; contact us and manage your subscription through Apple as appropriate.

You may stop using the app at any time, but separately cancel any active subscription if you do not want it to renew.

12. Warranties and liability

We aim to provide a useful and reliable app, but we cannot promise uninterrupted operation, perfect AI results, or compatibility with every device. To the extent permitted by law, features are provided without additional guarantees beyond those expressly made and those required by law.

To the extent permitted by law, we are not liable for indirect or consequential losses that are legally excludable. This does not exclude responsibility for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that applicable law does not allow us to exclude or limit. Mandatory consumer guarantees and remedies remain in force. The relevant Apple license may also address the software's warranties and liability.

13. Applicable law and disputes

These service terms are governed by Moroccan law to the extent permitted by applicable law. This does not deprive you of mandatory protections available under the laws of your country of residence or any right to bring a claim before a court available to you under those laws. The applicable Apple software license may contain its own governing-law rules for that license.

If a problem arises, contact belmatraghalima@gmail.com so we can try to resolve it. Contacting us does not remove your right to seek a statutory remedy or approach a competent authority. If part of these terms is unenforceable, the remaining terms apply to the extent legally permitted.

14. Changes to these terms and contact

We may update these terms when features, purchase arrangements, providers, or legal requirements change. We will update the date above and give additional notice or obtain agreement where required for a material change. Changes will not retroactively remove accrued consumer rights or replace Apple's required purchase confirmations.
